IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CRM-M-36306-2021 Date of Decision: 03.09.2021 Mohd. Bashis (Kabariya)................................Petitioner

Versus

State of Punjab................................................. Respondent CORAM : HON'BLE MRS. JUSTICE MANJARI NEHRU KAUL ...

(through video conferencing)

Present:

Mr. T.P.S.Bhatti, Advocate for the petitioner.

...

MANJARI NEHRU KAUL, J. (Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No. 326 dated 05.06.2018 registered at Police Station Focal Point, Ludhiana under Sections 392/342/506/ 120-B IPC (later on Sections 411/458/376-D added but petitioner charge-sheeted only under Sections 392/458/341 IPC read with Section 120-B and 506 IPC vide order dated 29.11.2018) and protection against Proclaimed offender Order dated 22.01.2021 (Annexure P4).

Learned counsel submits that the petitioner was released on regular bail and thereafter he had been regularly appearing during the proceedings before the trial court. However, he absented on account of the death of a relative, for which he had to travel all the way to his native village in Bihar. Subsequently, order dated 22.01.2021 (Annexure P4) RUPINDER KAUR 2021.09.03 16:54 I attest to the accuracy and integrity of this document declaring him a Proclaimed Offender was passed. Learned counsel submits

CRM-M-36306-2021 [ 2 ] that since the petitioner was stuck in his native village firstly on account of death of his relative and then on account of the outbreak of the pandemic he was unable to appear before the court below.

Heard.

No ground to extend the concession of anticipatory bail to the petitioner is made out as he admittedly is a Proclaimed Offender. The petition is dismissed.
