(Oral) Petition herein is, inter alia, for issuance of a writ in the nature of Mandamus to direct respondent No.2 to consider an application dated 23.08.2023 (Annexure P-1), submitted by the petitioner, before respondent No.2 for issuance of the passport in favour of the petitioner. 2.

Learned counsel appearing for the respondents/Union of India has informed the Court that one case FIR No.02 dated 02.01.2016, under Sections 323, 341, 506 and 34 of the Indian Penal Code, stands registered against the petitioner at Police Station Mulepur, District Fatehgarh Sahib and that an information in that regard has been sought from the police authorities.

CWP-14884-2025 (O&M) -2who is present in the Court, submits that so far as FIR No.02 dated 02.01.2016 is concerned, a cancellation report was prepared and the same was submitted before the concerned trial Court, however, the same was rejected and the matter is still under investigation. 4.

Learned counsel for the petitioner, in view of the aforesaid statement made by learned State counsel, submits that in the aforementioned circumstances, the case of petitioner herein is squarely covered by the judgment passed by a co-ordinate Bench of this Court in "Mohan Lal @ Mohna Vs. Union of India and others", 2023 (3) RCR (Civil) 772. 5.

Learned counsel appearing for respondent(s)/Union of India does not dispute the aforesaid position and submits that the case of petitioner for issuance of the passport would be considered by the concerned authority in the light of decision rendered in Mohan Lal @ Mohna's case (supra) and a final decision on the application for issuance of passport shall be taken within a period of two months from today.

Keeping in view the aforesaid submissions made by learned counsel for the parties, the instant writ petition is disposed of with a direction to the concerned authority/Officer to consider and decide the application for issuance of passport submitted by the petitioner in the light of judgment rendered by a co-ordinate Bench of this Court in Mohan Lal @ Mohna's case (supra) within a period of two months from today. 7.
