The instant petition has been filed by the petitioner under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in case FIR No.75 dated 12.06.2023, under Section 376(2) IPC, 1860 and Section 6 of Protection of Children from Sexual Offences Act, 2012, registered at Police Station Nangal, District Rupnagar.

Learned counsel for the petitioner contends that the petitioner is in custody since 12.06.2023.

Learned State counsel has filed custody certificate of the petitioner dated 23.07.2024, reflecting his period of custody as 01 year 01 month and 08 days, which is taken on record. It has been further informed that out of total 17 prosecution witnesses, 14 prosecution witnesses have been examined, 02 witnesses have been given up and only 01 prosecution witness is left to be examined. 4.

Learned State counsel confirms that the Investigating Officer shall make an endeavour to record the statement of the remaining prosecution witness on SIMRANDEEP KAUR 2024.07.26 10:06 I attest to the accuracy and integrity of this order/judgment.

CRM-M-34162-2024  the next date of hearing, which is stated to be 07.08.2024. Copy of the DNA examination report has also been submitted in the Court today, which is taken on record.

The age of the victim is 16 years and the age of the petitioner is 56 years. The allegations against the petitioner are attracting offence under Section 6 of the Protection of Children from Sexual Offences Act, 2012. 6.

The trial is almost complete. In view of such circumstances, the present petition is disposed of with directions to the trial Court to conclude the trial within a period of 03 months from the date of receiving a copy of this order. 7.
