The State counsel has informed that the appeal filed by the petitioner against the order dated 7.9.2020 is pending before the Superintending Engineer, Haryana Sheri Vikas Pradhikaran (HSVP), Faridabad. Though this fact is not disputed by learned counsel for the petitioner but he has contended that this appeal is pending for more than six months.

Under the circumstances, since appeal filed by the petitioner is pending before the Appellate Authority, it would be better if the Appellate Authority decides the appeal in view of the facts and circumstances of the case, as per law, in light of rules, regulations and instructions/norms on the subject. However, a direction can be issued to such Appellate Authority to decide the appeal expeditiously.

CWP No.17389 of 2021 Accordingly, the writ petition is disposed of directing the Appellate Authority i.e. Chief Administrator HUDA/Superintending Engineer, Haryana Sheri Vikas Pradhikaran (HSVP), Faridabad, as the case may be, to hear and dispose of the appeal filed by the petitioner within two months from the date of receipt of copy of this order and a speaking order in that regard is required to be passed, a copy of which be sent to the petitioner.

Disposed of in the above terms.

In case the petitioner still feels aggrieved, he can avail of the remedy available to him as per law.
