(Oral) The petitioner has approached this Court seeking issuance of a direction to respondents No.1 to 3 to conduct a fair and impartial investigation in FIR No. 264, dated 25.4.2021, Police Station Mujesar, District Faridabad, under Sections 323, 34, 452 and 506 IPC. The allegations, in nutshell, are that the accused had given a blow with 'stick' on the right hip of complainant's mother-in-law. While the said blow was given on 15.4.2021, the complainant's mother-in-law expired on 5.6.2021 on account of cardiac arrest.

Learned counsel for the petitioner submits that the death of the complainant's mother-in-law was solely on account of the injury inflicted by accused Dharambir but somehow police has chosen not to add any offence under Section 304 or 302 IPC.

- 2 - CRM-M-36161-2021 (O&M) Having heard the learned counsel for the petitioner and while refraining from making any expression as regards the averments made in the petition, the instant petition is disposed of with a direction to respondent No.2-Commissioner of Police, Faridabad, to ensure that the matter pertaining to FIR No. 264, dated 25.4.2021, Police Station Mujesar, District Faridabad, under Sections 323, 34, 452 and 506 IPC, is got investigated expeditiously in accordance with law so that a final report is submitted thereafter at the earliest. The Investigating Officer shall also consider the medical evidence in respect of the injuries allegedly sustained by the deceased and regarding the cause of death while filing final report in the matter.
