The petitioner, belongs to General Category, joined respondent No.19Board as Clerk on 29.12.1971. He was promoted as Superintendent on 25.01.1994. Darbara Singh, who was junior to the petitioner, belong to Schedule Caste Category, was appointed as Clerk by the respondent9Board on 20.03.1972. However, having been given the benefit of reservation, said Darbara Singh was promoted as Superintendent on 13.12.1989.

The petitioner relies on a decision dated 06.12.2012 of this Court in CWP No.18307 of 2011 titled as '

CWP No. 1592 of 2015 99299 Counsel for the petitioner submits that despite sending legal notice dated 15.11.2014 to the respondents in this regard, no action has been taken so far. Learned counsel for the petitioner states that at this stage, the petitioner would be satisfied if a time bound direction is given to respondent No.1 to take action on the above said legal notice.

Accordingly, the present writ petition is disposed of with a direction to respondent No.1 to take into consideration legal notice dated 15.11.2014(Annexure P95) and dispose of the same by passing a speaking order expeditiously preferably within a period of two months from the date of receipt of a certified copy of this order.
