(Oral) :

Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.146 dated 29.07.2021 under Sections 363, 366-A, 509 IPC registered at Police Station City Malout, District Sri Muktsar Sahib. Learned counsel submits that the victim who was just 08 days short of attaining majority, was having an affair with the petitioner. He submits that since the complainant was aware of the said fact and was not favourably inclined towards the said relationship between his daughter and the petitioner, the FIR in question was registered. He further submits that the victim allegedly went missing on 26.07.2021 and was recovered on the same day and thereafter she got recorded her statement under Section 164 Cr.P.C. wherein she did not allege any thing against the petitioner and rather submitted that she had left her house of her own accord. Learned counsel submits that in compliance of the order dated 07.09.2021, the petitioner has joined investigation and co-operated with the investigating agency.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation. He has further apprised this Court that the petitioner is no longer required for further interrogation.

In view of the above, the petition is allowed and interim order dated 07.09.2021 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
