The petitioners have sought a writ of mandamus for directing the respondents that notice inviting tenders be floated in consonance with the principle as enshrined in Articles 14 and 19(1)(g) of the Constitution. We find that the petitioners have no right to seek a direction that notice inviting tenders be floated in a particular manner. The question whether a particular condition of the tender is illegal, arbitrary or unreasonable, can be examined only after the notice inviting tenders is published and any of the rights of the petitioners is affected.

At this stage, we find that the writ petition is fully misconceived and premature. The same is dismissed.
