The present petition filed under Section 482 Cr.P.C., the petitioner seeks quashing of FIR No.61, dated 01.04.2021 registered under Sections 354-A and 509 IPC at Police Station City Rupnagar on the basis of compromise dated 19.05.2021 (Annexure P-2). The brief facts of the case are that Harpreet Kaur, complainant filed application before SSP, Rupnagar with the prayer for taking action against Pritam Singh, Technical Assistant. It is alleged that on 15.09.2020 at about 5:15 pm the applicant was in the office with regards to some urgent work when Pritam Singh suddenly caught hold of her hand on account of this behavior the matter was reported to the Higher Officer and the present FIR has been registered under Section 354-A and 509 IPC against Pritam Singh.
-2The petitioner has filed the present petition for quashing of FIR on the basis of compromise. The respondent No.2-Harpreet Kaur appeared through her counsel and confirmed the compromise. Both the parties were directed to appear before the Judicial Magistrate, First Class, Rupnagar for recording of their statements on the basis of compromise. The detailed report dated 03.09.2022 regarding compromise has been received. The statements of the parties were also recorded. Harpreet Kaur-respondent No.2 confirmed the compromise with the petitioners and further stated that it has been effected voluntarily without coercion and undue influence. Similarly, the petitioner also appeared before the Judicial Magistrate, First Class, Rupnagar and confirmed the compromise arrived at between the parties.
ASI Mohinder Pal stated that the petitioner is not involved in any other criminal case nor he has been declared proclaimed offender. I have considered the compromise report received from the Court of Judicial Magistrate, First Class, Rupnagar which clearly indicates that the matter has been compromised between the parties with their free consent without any coercion or undue influence. It cannot be ignored that the complainant/respondent No.2 Harpreet Kaur and petitioner Pritam Singh are serving in the same department and even in future they will be working in the same office. It is good for the petitioner as well as respondent No.2 that they have mutually settled their dispute. It will also bring peace, harmony and discipline in the office.
There is nothing on record to show that the petitioner is involved in any other case nor he has been declared a proclaimed offender.
-3Under these circumstances, no purpose would be served with the continuation of criminal proceedings in the aforesaid FIR. Therefore, the compromise arrived at between the parties is accepted, accordingly FIR No.61, dated 01.04.2021 registered under Sections 354-A and 509 IPC at Police Station City Rupnagar along with consequent proceedings are quashed by accepting the present petition. The petition is accordingly disposed of.
