Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 87 dated 01.05.2016, registered under Section(s) 18 of the Narcotic Drugs & Psychotropic Substances Act, 1985 (Section 473 IPC was added lateron) at Police Station City Tarn Taran, District Tarn Taran.
Learned counsel for the petitioner contended that petitioner was earlier admitted to bail and subsequently, final report under Section 173 Cr.P.C. was filed in his absence. However, learned counsel fairly conceded that after filing of the challan, petitioner was not present in the learned trial Court on three/four dates without any justified reason. As such, no case is made out to grant the concession of prearrest bail to the petitioner and present petition stands dismissed.
