"# It is pointed out by learned Counsel for the petitioner that the petitioner has completed nearly 05 years of actual custody and the prosecution evidence has so far not been concluded. Learned State Counsel however, contends that the earlier bail petition filed by the petitioner viz. CRM-M-35659-2023 was dismissed on 06.02.2025 after noticing that 12 prosecution witnesses remained to be examined. A direction was issued to conclude the trial expeditiously and preferably within a period of four months and that as many as 10 witnesses have been examined and only 02 prosecution witnesses remain to be examined. He contends that the case is now fixed before the trial Court for recording of the testimony of the remaining prosecution witnesses on 13.11.2025.
Taking into consideration the advanced stage of case and also that the earlier bail petition was dismissed on 06.02.2025, I refrain from commenting on the merits of the present case. Further, noticing the period of custody already undergone, the trial Court is directed to conclude the prosecution evidence within a period of 01 month of the date next fixed before the trial Court for recording of the prosecution evidence (in case the prosecution evidence is not complete on the next date of hearing). With the above direction, the present petition is disposed of at this stage.
