Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 31 dated 12.05.2019, registered under Section(s) 307, 323, 324, 341, 506, 427, 148 & 149 IPC at Police Station Purana Shalla, District Gurdaspur.
Learned counsel for the petitioner contended that petitioner has been falsely implicated in the case and he was not named in the FIR, rather his name was disclosed in the disclosure statement recorded by his coaccused on the next day i.e. 13.05.2019 and allegations against the petitioner are at the best under Section 323 IPC.
Having considered the submissions made by learned counsel for the petitioner and facts of the case, petitioner is one of the accused along with other accused for the offence under Section 307 IPC read with Section 149 IPC and he would be required for the purpose of effective investigation as the recovery of weapon is yet to be effected.
