The petitioner through the instant petition filed under Articles 226/227 of the Constitution of India, has prayed for issuance of a writ in the nature of certiorari for quashing the show cause notice dated 15.5.2015 (Annexure P-3) issued by respondent No.2 for cancellation of plot No. 363, Sector 32, Urban Estate, Karnal, measuring 14 marlas. 2.

Plot No. 363, Sector 32, Urban Estate, Karnal measuring 14 marlas was allotted to Smt. Raj Bala vide allotment letter dated 11.5.2012 (Annexure P-1) for an amount of ` 28,94,539/- (tentative). The petitioner purchased the said plot vide re-allotment letter dated 12/19.11.2012 (Annexure P-2). The petitioner kept on making payments and all other dues well in time without committing any default. A show cause notice dated 15.5.2015 (Annexure P-3) was received by the petitioner for cancellation of the plot in question. CWP No. 15973 of 2015 -2no response has been received till date. Hence, the present writ petition. 3.

Learned counsel for the petitioner submitted that for the relief claimed in the writ petition, the petitioner has sent a legal notice dated 29.5.2015 (Annexure P-4) to the respondents, but no action has so far been taken thereon.

After hearing learned counsel for the petitioner, perusing the present petition and without expressing any opinion on the merits of the case, we dispose of the present petition by directing respondent No.2 to take a decision on the legal notice dated 29.5.2015 (Annexure P-4), in accordance with law by passing a speaking order and after affording an opportunity of hearing to the petitioner within a period of three months from the date of receipt of certified copy of the order.
