The petitioner is seeking the concession of bail under Section 439 of the Cr.P.C. in case FIR No.142 dated 07.10.2020 under Sections 15/25 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the NDPS Act') (Section 29 of the NDPS Act added later on) registered at Police Station Barnala, District Barnala. 2.

On 11.08.2023, when this Court was not inclined to grant the concession of regular bail to the petitioner, learned counsel for the petitioner restricted his prayer for grant of bail to the petitioner on medical grounds only.

Today, learned State counsel has filed medical status report of petitioner Gurpreet Singh son of Darshan Singh, which is taken on record. While drawing the attention of this Court to the said report, learned State counsel has submitted that on being admitted to AIIMS, he was managed conservatively. His MRI, which was done on 08.08.2023, did not show any signs of stroke. Learned counsel submits thus, the ground on which the petitioner is seeking interim bail is not PUNEET SACHDEVA 2023.10.06 15:55 I attest to the accuracy and integrity of this document.

In the wake of the report received by the learned State counsel, which is contrary to the submissions made by the counsel opposite with respect to the medical condition of the petitioner, no ground is made out to extend the concession of interim bail to the petitioner.

The instant petition, therefore, stands dismissed. 6.

However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case.
