The petitioner prays for grant of regular bail pending trial in a criminal case arising from FIR No. 105 dated 13.09.2018, registered under Section 406, 420, 467, 468 & 471 IPC, at Police Station Division No. 4, Patiala.
As per the case of the prosecution, the petitioner has received a sum of ₹ 14,50,000/-while falsely promising to secure admission of daughter of the first Informant in a medical college. The allegations are against Gurinder Singh Randhawa. The prosecution alleges that the petitioner impersonated as Gurinder Singh Randhawa. In support thereof, they have collected Adhhar Card which has the photograph of the petitioner with the name of Gurinder Singh Randhawa The petitioner is in detention since 30.06.2019 and the case is DEEPAK KUMAR BHARDWAJ 2020.10.13 13:25 I attest to the accuracy and integrity of this document
Criminal Misc. No. M- 31519 of 2020 triable by Judicial Magistrate Ist Class. The trial Court has not started recording the evidence of the prosecution as yet. Ms. Samina Dhir, Deputy Advocate General, Punjab has pointed out that the petitioner does have another case against him under Section 379 & 411 IPC.
Be that as it may. The petitioner is in custody for more than one year and three months. The conclusion of the trial is likely to take time. The petitioner has already suffered incarceration for quite some time. Keeping in view the aforesaid facts and without expressing any opinion on the merits of the case, it is considered appropriate to direct the petitioner to be released on regular bail as the conclusion of the trial is likely to take time. Hence, the present petition is allowed and the petitioner is ordered to be released on regular bail subject to his furnishing bail/surety bonds to the satisfaction of the learned Area Judicial Magistrate/Chief Judicial Magistrate/Duty Magistrate.
