(Oral) The petitioners are co-sharers in the land described in para nos.2, 3 & 4 of the writ petition, a part of which appears to have been acquired by the National Highway Authority of India. Respondent Nos.4 & 5 are also co-sharers in the said land as they have purchased it in part subsequently. The dispute is with regard to apportionment of compensation amount amongst the co-sharers. Partition proceedings are also pending between the parties.

In our considered view, the petitioners have got sufficient alternative remedy to approach the Statutory Authority under the National Highway Act, 1956 and/or pursue the partition proceedings and get their shares determined so as to become eligible to receive compensation to the Mohinder Kumar Kamboj 2016.08.16 14:45 I attest to the accuracy and integrity of this document Chandigarh extent of their share in the acquired land.
