(ORAL) In the present case, the petitioner is asking for the re-fixation of pay of her late husband w.e.f. 01.05.1990 by granting the pay-scale of `1200-2040 and further revised pay-scale of `4000-6000 w.e.f. 01.01.1996.

The contention which has been raised by the petitioner in the present writ petition is that similarly situated persons have already been granted the said benefit, whereas the same was denied to the husband of the petitioner. Counsel for the petitioner further states that the matter is pending since long and for this purpose the petitioner had filed a representation (Annexure P-6) on 30.06.2014. CWP-16013-2015 (O&M) -2for the enhanced family pension after re-fixing the pay of her late husband. Counsel for the petitioner further states that even though the matter is pending for the last more than three years, at this stage, the petitioner will be satisfied if a direction is given to the respondent(s) to decide her representation by taking into consideration the various orders passed by this Court, which have been attached as Annexures P-1 to P-3, within a time bound banner.

Counsel for the respondent(s)-State has no objection for granting the said request of the petitioner.

In view of above, let competent authority pass a speaking order on the representation (Annexure P-6) filed by the petitioner by taking into consideration the judgments (Annexures P-1, P-2 and P-3) of this Court. The said order be passed within a period of three months from the date of receipt of a certified copy of this order. It is made clear that this Court expresses no opinion on the merits of the case at this stage. Present writ petition stands disposed of.
