(Oral) Prayer is for grant of anticipatory bail in case having FIR No.132 dated 8.6.2021 registered under Sections 147, 149, 427, 506 IPC (Section 448 IPC deleted later on) and Sections 452, 506, 201, 120-B IPC and Section 25 of Arms Act added later on at Police Station City Ratia District Fatehabad.
The counsel for the petitioners submits that the petitioner has been falsely implicated in this case as the civil litigation is still going on between the parties and no one sustained injuries at the time of alleged PUNEET CHAWLA 2022.11.02 12:04 I attest to the accuracy and authenticity of this order/judgment
( 2 ) CRM-M-32305-2022 occurrence. Counsel for the petitioner submits that the petitioner has joined investigation with the police by virtue of previous order dated 27.7.2022 passed by Coordinate Bench of this Court.
State counsel on instructions from ASI Avtar Singh has not refuted the aforesaid assertions made by counsel for the petitioner and submits that petitioner who has associated with the investigation is not required by police for further investigation or for custodial interrogation. However the present petition is resisted by the counsel for the complainant but he has not disputed the fact that it is no injury case and litigation with regard to property is going on between the parties. In view of the above, without commenting on the merits of the case, the present petition is hereby allowed and order dated 27.7.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
