Daya Chaudhary, J. (Oral) The grievance of the petitioner in the present writ petition is that he has been transferred from Hisar to Jhajjar, which is far away place.
Learned counsel for the petitioner submits that the wife of the petitioner is also working and their children are still undergoing studies. Hence, the transfer order of the petitioner is contrary to the policy as a concession has to be given in couple case. Learned counsel further submits that three transfers are interconnected i.e., Sr. Nos.24, 25 and 46 and in case, the said employees are to be transferred for any reason, the petitioner can be adjusted at a nearby place to Ratia (Fatehabad). CWP No.16058 of 2015 representation to the concerned authorities but no action has been taken so far. Learned counsel also submits that there are certain other persons, who are having longer stay than the petitioner whereas they have not been transferred. As per instructions/policy, the persons, who have stayed for a longer time at a particular place are to be transferred.
In view of the submissions made by learned counsel for the petitioner and without issuing any notice to respondents, the present writ petition is disposed of with a direction to respondent No.2 to consider the representation (Annexure P-3) moved by the petitioner. The respondents are directed to consider in case, the petitioner can be adjusted at Ratia and the persons, who have been transferred from Ratia to Hisar can be adjusted at the place where the petitioner was posted, the needful be done by considering the representation moved by the petitioner from this point of view.
