The petitioner has filed the present petition praying for quashing FIR No.133 dated 04.09.2013 under Sections 4A/8, 2/80 of Punjab Prohibition of Cow Slaughters Act, 1955 registered at Police Station Nagina, District Mewat and all subsequent proceedings arising therefrom, including the order dated 16.01.2014 passed by JMIC, Jhirka whereby the petitioner has been declared as a proclaimed offender. At the outset, learned counsel for the petitioner prayed that he would be satisfied if he be allowed to appear before trial Court to face trial by granting interim protection.

The FIR was got registered against the petitioner and the coaccused. The co-accused of the petitioner have been acquitted vide judgment and order dated 08.12.2018 of Judicial Magistrate Ist Class, Ferozepur, Jhirka. The petitioner is 72 years of age. No notice or summons were ever received by the petitioner. Even the Sarpanch of the Village, where petitioner is stated to be resident confirmed the fact that the petitioner was not residing at the given address. The petitioner may appear before the trial Court on or before 14.10.2021. On his doing so, he shall be released on interim bail by trial Court to its satisfaction. This shall, however, be subject to deposit of an amount of Rs.20,000/- by the petitioner in the Haryana Police Welfare Fund, through DGP Headquarters. He shall also furnish an undertaking that he would appear before the trial Court as and when directed. Disposed of.
