The present writ petition has been filed under Articles 226/227 of the Constitution of India averring therein that the petitioners have filed an appeal, which is pending before respondent No.2 - Collector-cum-Deputy Commissioner, Fatehabad - alongwith an application for stay. 2.

Learned counsel for the petitioners has stated that though the appeal was filed alongwith the application for stay on 27.04.2026, however, no order has been passed on the application for stay despite the appeal being a statutory appeal. Learned counsel further states that he limits his prayer in the present petition and that the petitioners would be satisfied if a direction is given to respondent No.2 to decide the stay application in a time-bound manner and till such time as the application for stay is decided, no coercive action be taken.

Mr. Saurabh Mago, DAG Haryana accepts notice on behalf of respondent Nos.1 to 4/State. Learned State counsel is not in a position to deny that the stay application has not been dealt with by respondent No.2 till date despite the appeal having been filed on 27.04.2026. 5.

In view of the above, the present petition is disposed off with a direction to respondent No.2, Collector-cum-Deputy Commissioner, Fatehabad, Haryana, to decide the stay application expeditiously and in accordance with law and till such time as the application for stay is decided, no coercive action would be taken against the petitioners. 6.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
