Through the instant petition, petitioner is seeking anticipatory bail in case FIR No. 74 dated 18.04.2024 registered under Sections 498-A, 323 and 34 of IPC at Police Station City-2 Khanna, District Khanna (Punjab). 2.

On 18.06.2024, following order was passed:

"The prayer in this petition under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No. 74 dated 18.04.2024 under Sections 498-A, 323, 34 of IPC registered at Police Station City-2 Khanna, District Khanna (Punjab).

Learned counsel for the petitioner inter-alia submits that it is a matrimonial dispute and allegations against the petitioner are that he has borrowed a sum of Rs.20,000/- but did not return. He has also referred a copy of petition filed under Section 125 Cr.P.C wherein it was mentioned by the complainant that prior to the marriage, the petitioner (complainant of this case) got borrowed a sum of Rs. 50,000/- and Rs.20,000/- at the instance of the petitioner.

Notice of motion.

On asking of the Court, Sh. Manmeet Singh Teji, AAG, Punjab appears and accepts notice on behalf of the respondent-State and seeks time to file status report. In the meantime, petitioner is directed to join investigation as and when called by SHO/Investigating Officer and in the event of his arrest, he shall be released on interim bail on his furnishing bail bonds to the satisfaction of SHO/Investigating Agency, subject to the following conditions as envisaged under Section 438 (2) Cr.P.C.:- (i) that the petitioner shall make himself available for interrogation before the investigating officer as and when required: (ii) that the petitioner shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that the petitioner shall not leave the country without prior permission of the Court concerned.

Status report be filed on or before the next date of hearing with an advance copy to the counsel opposite.

Learned State counsel on instructions from ASI Sukhwinder Singh, submits that in compliance of order dated 18.06.2024 passed by this Court, the petitioner has joined the investigation and is not required for further custodial interrogation.

Keeping in view the statement made by learned State Counsel the order dated 18.06.2024, is made absolute. The petitioner shall abide by the terms and conditions enumerated in Section 438(2) of Cr.P.C. 5.

The petition is accordingly allowed.
