Rakesh Kumar v. Vijay Kumar
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CR NO.4048 OF 2019 (O&M) DECIDED ON: 04.07.2019 RAKESH KUMAR ...PETITIONER..
VERSUS
VIJAY KUMAR ...RESPONDENT..
CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present: Mr. Ramnish Puri, Advocate for the petitioner. ***** RAMENDRA JAIN, J. (ORAL) Through this revision under Article 227 of the Constitution of India read with Section 151 CPC, the petitioner has laid challenge to impugned order dated 19.04.2019 (P-5) of the appellate court, vide which, mesne profit of the demised shop has been assessed at the rate of `5,000/- per month.
Heard.
Considering the settled rent of `500/- in between the petitioner and respondent-landlord, in the year 1992 i.e. around 27 years back, mesne profit of the demised shop fixed by the appellate court @ `5000/- per month from the date of order of eviction, is not on higher side.
Hence, finding no merit in the instant petition. The same is dismissed.
