(ORAL) The petitioner has filed this petition being aggrieved by the fact that the respondent-authorities by ignoring her claim for admission in the M.Sc. Nursing Course for the session - 2021 under the General Category have granted admission to private respondents No. 5 and 6 who are below in merit to the petitioner and belong to the Other Backward Class (OBC) Category. It is submitted that the petitioner has filed representations dated 14.08.2021 (Annexure P-5) and 25.08.2021 (Annexure P-6) before the respondent-authorities, but no decision thereon has been taken by them. It is further submitted that the respondent-authorities have wrongly adjusted the private respondents No. 5 by considering the order dated 27.07.2021 passed by this Court in CWP-13615-2021 filed by him as a mandate in his favour which is factually incorrect.

Learned counsel appearing for respondents No. 1 to 4 on advance copy submits that the competent authority shall examine the representations dated 14.08.2021 (Annexure P-5) and 25.08.2021 (Annexure P-6) filed by the petitioner; take a decision thereon within three days and communicate the same to her accordingly.

In view of the aforesaid statement made by learned counsel for AMODH SHARMA 2021.09.06 11:41 I attest to the accuracy and integrity of this document respondents No. 1 to 4, we do not find any reason to entertain the present

CWP-17211-2021 (O&M) petition which is disposed of. It is made clear that this Court has not expressed any opinion on the merits of the case and, therefore, the authorities would be at liberty to examine the matter keeping all facts and facets into consideration and thereafter accept or reject the same in accordance with law.
