This is second petition under Section 439 of the Criminal Procedure Code, 1973 for grant of regular bail to the petitioner in pending trial of case bearing FIR No.114 dated 30.06.2020 (Annexure P-1) under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Samrala District Khanna.
The present case pertains to recovery of 60 grams of intoxicant power i.e. Methamphetamine, which is claimed by the petitioner to have been recovered from ground, while the prosecution contends that the petitioner had thrown the contraband on the ground on seeing the police party. Learned State Counsel, however contends that the petitioner is already convicted in case bearing FIR No.131 dated 15.12.2011 registered under Section 15/25 of the NDPS Act, 1985 at Police Station Chhajali wherein he has been convicted to undergo rigorous imprisonment for 10 years vide judgment dated 18.07.2014 passed by Judge, Special Court, Sangrur. further points out that total 11 witnesses have been cited by the prosecution and out of them only 04 witnesses have been examined so far. It is also pointed that the next date for prosecution evidence before the trial Court is fixed for 21.11.2022. She further assures that the prosecution shall make every endeavour to conclude its evidence within a period of four months from the date next fixed before the trial Court for recording of prosecution evidence. In view of the aforesaid statement made at Bar today by the learned State counsel, learned counsel for the petitioner does not press the instant petition at this stage.
Disposed of as not pressed, at this stage.
State shall, however, remain bound by its undertaking and make every endeavour to conclude its prosecution evidence within the time frame as stated above.
