(Oral) Prayer is for grant of anticipatory bail in case having FIR No.108 dated 30.06.2020 registered under Section 307 IPC and Section 25 of Arms Act at Police Station Bhattu Kala, District Fatehabad. The counsel for the petitioner submits that the alleged firing was not committed by the present petitioner and she has been arraigned as an accused only on the ground that fire arm used in alleged firing was licensed weapon of the petitioner. The counsel for the petitioner further submitted GAURAV SOROT 2022.08.26 15:34 I attest to the accuracy and authenticity of this order/judgment

( 2 ) CRM-M-32707-2022 that the petitioner has joined investigation by virtue of previous order dated 28.7.2022.

The State counsel on instructions from ASI Parveen Kumar has not disputed the fact that the petitioner has joined investigation with the police. The State counsel further submitted that recovery of fire arm has been effected and the petitioner is not required by police for further investigation or for custodial interrogation. In view of the above as the recovery has already been effected and the only allegations against the petitioner are that her licensed fire arm was misused by her nephew namely Ramesh, no purpose is going to the served even if the petitioner is subject to custodial interrogation at this stage. Thus, without commenting on the merits of the case, present petition is allowed and order dated 28.7.2022 is hereby made absolute.
