AT CHANDIGARH Date of decision:01/08/2016 Labh Singh and others ............Petitioners vs State of Punjab and others .............Respondents CORAM:- HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Gurbhajneek Singh Samra,Advocate for the petitioners Jaswant Singh,J(Oral) Petitioners 1 and 2 namely Labh Singh, Satpal Singh and petitioner no.6 Bhag Singh are stated to be promoted as Junior Assistants w.e.f. 1.1.1996 from the rank of Clerk in the Department of Local Bodies,Punjab whereas petitioners 3 to 5 namely Ravinder Singh, Amarjit Singh and Ujagar Singh stood similarly promoted as Junior Assistants w.e.f. 1.3.2000, 1.3.1998 and 1.3.2009 respectively in the same department. Prayer in the instant writ petition was for grant of pay scale of Rs.5000-8100 w.e.f 1.1.1996 in the rank of Junior Assistants in terms of order dated 16.5.

2012 (P-3) passed by this Court in CWP 22422/2010 (Anil Kumar and others v State of Punjab and others). At the time of hearing, learned counsel for the petitioners prays for permission to withdraw the petition qua petitioners no. 1,2 and 6 i.e. Labh Singh, Satpal Singh and Bhag Singh who stood promoted as Junior Assistants on 1.1.1996 so as to file separate writ petition on their behalf whereas qua the remaining three petitioners the petition would be dismissed Rajinder Parshad Joshi 2016.08.

In view of the above, present petition qua petitioners 1,2 and 6 namely Labh Singh,Satpal Singh and Bhag Singh stands dismissed as withdrawn to enable them to file a separate petition whereas qua petitioners 3 to 5 i.e. Ravinder Singh, Amarjit Singh and Ujagar Singh the petition stands dismissed in terms of order dated 1.8.2016 passed in CWP 15133 of 2016.
