Prayer in the instant petition filed under Article 227 of the Constitution of India is to set aside the order dated 31.05.2023 (Annexure P1), passed by learned Civil Judge (Junior Division), Narwana, whereby application dated 19.11.2020 (Annexure P-4) filed by defendant no.10 (respondent no.10 herein) for rejection of plaint has been allowed and plaint of the plaintiffs/petitioners has been rejected. 2.
After arguing for some time, when faced with the situation as to how this petition is maintainable during pendency of the appeal against order dated 19.11.2020 (Annexure P-4), learned counsel for the petitioners states that he wants to withdraw the present revision petition, with liberty to take all the objections before the learned Appellate Court. He has further submitted that the appeal filed by the petitioners was entertained during summer vacation. Even learned Vacation Judge heard the arguments but did not pass the order of interim injunction and posted the matter from MONIKA 2023.07.17 17:13 I attest to the accuracy and integrity of this document

Without commenting upon the merits of the case, the present petition is dismissed as withdrawn with liberty as aforesaid. 4.
Learned Appellate Court is directed to decide the appeal filed before it within 15 days positively from the date of receipt of this order, after giving notice to the opposite party through its counsel. 5.
Pending applications, if any, shall stand disposed of along with this judgment.
