The present petition has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of certiorari quashing impugned order dated 11.2.2016 (Annexure P-12), whereby, the petitioner has been dismissed from service on account of his conviction in case FIR No. 32 registered under Sections 409,419,420,467,468,471 IPC vide judgment dated 8.12.2015.

Although certain arguments have been raised by learned counsel for the petitioner to challenge the order of dismissal but admittedly the appeal filed by the petitioner is still pending and same has not been decided. Even a legal notice was also served upon the respondents on 24.5.2016 but no action has been taken thereupon so far. Learned counsel for the petitioner contends that the petitioner would be satisfied in case directions are issued to the respondents by this

In view of the submissions made by learned counsel for the petitioner, by considering the limited prayer and without commenting anything on the merits of the case, the present petition is disposed of with a direction to respondent No.2 to decide the pending appeal of the petitioner, expeditiously, as early as possible preferably within a period of three months from the date of receipt of copy of the order. In case personal hearing of the petitioner is required, he be given an opportunity of hearing.
