CORAM:HON'BLE MR. JUSTICE AMIT RAWAL -.- AMIT RAWAL J.(ORAL) Learned counsel for the petitioners submits that he has no instructions as the parties have already taken the brief. This matter was being adjourned on the ground that a similar writ petition bearing No.21598 of 2012 against the order of the Financial Commissioner had been dismissed on 01.11.2012 and the status quo in the letters patent appeal had been granted. However, it has been brought to the notice of this Court by the registry that LPA bearing No.1750 of 2012 vide order dated 30.04.2015 has been dismissed as withdrawn. It appear that the petitioners are not interested in pursuing the matter regarding the partition proceedings whereby the naksha bey and sanad takseem has been passed. The order of the Sanad Takseem had been brought in appeal and the remedy of revision petition was also availed.

All the partition proceedings have been opposed by the petitioners-respondents before the Assistant Collector on the premise that the possession has been disturbed whereas all the authorities found that the petitioners were shown in possession of an excess area and therefore, the possession had to be disturbed.
