(ORAL) Prayer in this petition is for grant of anticipatory bail in complaint case bearing registration No.367 dated 21.04.2018 filed before the Judicial Magistrate 1st Class, Pathankot under Section 138 of N.I. Act. Learned counsel for the petitioner submits that the petitioner was never served in the complaint, which is filed on account of dishonouring of a cheque of Rs.3.70 lacs. It is further submitted that the petitioner is ready to appear before the trial Court and face the trial and in order to show his bonafide, he will hand over a demand draft of Rs.50,000/- favouring the complainant-respondent No.1 Pawan Kumar.

After hearing learned counsel for the parties, considering the fact that the petitioner is contemplating to join the proceedings and to explore the possibility of some settlement, he is ready to hand over a demand draft of Rs.50,000/- to the complainant, this petition is allowed. The petitioner is directed to surrender before the trial Court on or before 05.11.2020 and the trial Court will release him on bail subject to his furnishing bail/surety bonds and on deposit of demand draft of Rs.50,000/-, which will be handed over to the complainant without prejudice to right of defence of the petitioner and subject to final outcome of the case.
