***** HARNARESH SINGH GILL, J. (ORAL) Case is taken up for hearing through video conferencing. Through this petition, the petitioner seeks regular bail in case bearing FIR No.156 dated 24.06.2021, registered under Section 22 of the NDPS Act, at Police Station City Nawanshahr, Punjab. Learned counsel for the petitioner states that the alleged recovery of contraband has been effected from the boot space of the scooter, which was being driven by Baljit Singh with whom she got married about one and a half year ago. The petitioner has nothing to do with the said recovery and has been in custody since 24.06.2021 and there is no case registered or pending against the petitioner at least of similar nature.

Learned State counsel while opposing the prayer of the petitioner for grant of bail, has stated that it is a case of chance recovery but does not dispute that the petitioner being lady has been in custody since 24.06.2021. He further states that another FIR under Section 379 IPC is registered against the petitioner.

I have heard the learned counsel for the parties. The petitioner-Renu Bala was a pillion rider of the scooter, which was being driven by the co-accused Baljit Singh from which the recovery has been effected. There is no other case registered or pending against the petitioner under the NDPS Act, who has been in custody since 24.06.2021. The trial is unlikely to conclude any time soon. Therefore, no useful purpose would be served by keeping the petitioner behind the bars. In view of the above, without commenting anything on the merits, lest it should prejudice the case of either side, the present petition is allowed and the petitioner is ordered to be released on bail on her furnishing bail and surety bonds to the satisfaction of the learned trial Court/Duty Magistrate.
