MANJARI NEHRU KAUL, J. (ORAL) Prayer in the instant petition is for setting aside the order dated 22.04.2025 passed by learned Special Judge, CBI, Punjab, S.A.S. Nagar, in FIR No.RC 219 2016 E 0005 dated 06.04.2016 registered at Police Station CBI/E.O.-I, New Delhi. 2.

Learned counsel for the petitioner submits that while passing the order dated 22.04.2025, the trial Court has wrongly noticed that accused Harbhajan Singh (petitioner herein) has suffered a statement to the effect that he does not want to cross-examine PW-5 Kanwaljit Singh Sobti and PW-26 Nalin Tayal. Learned counsel submits that it is a matter of record that the petitioner had sought permission of this Court to cross-examine the said witnesses. In support, he has drawn the attention of this Court to Annexure P-2. 3.

I have heard learned counsel for the parties and perused the relevant material on record.

In the facts and circumstances, the instant petition is allowed in the following terms:-

1. The petitioner is granted last opportunity to cross-examine the PW-5 Kanwaljit Singh Sobti and PW-26 Nalin Tayal.

2. In the event of default by the petitioner, the case shall not be adjourned any further for cross-examining the said witnesses and the trial Court shall proceed with the trial.
