The writ petition for enforcement of contract for recovery of money is not competent and the appropriate remedy will be only by means of a civil suit for recovery. If, according to the petitioner, liability is an admitted fact, the petitioner may state so in a suit and take a decree in the manner provided under Order 10 CPC. 2.
