(ORAL) This is a petition filed under Articles 226/227 of the Constitution of India seeking issuance of a writ of certiorari quashing the Memo dated 07.12.2016 (Annexure P-12) of respondent No.2, rejecting the appeal of the petitioner; as also quashing of order dated 18.08.2016 (Annexure P-9) passed by respondent No.4 and order dated 14.09.2016 (Annexure P-10) passed by respondent No.4, rejecting the application filed by the petitioner under Rule 70(5) of the Punjab Factories Act, 1952, for exemption from the provisions of Section 45(4) of the Factories Act, 1948 and from the requirement of Rule 70 of the Factories Rules, 1952; as also seeking issuance of a writ of mandamus directing the respondents to grant exemption to the petitioner in terms of the provision of Section 45(4) of the Factories Act, 1948 and from requirement of Rule 70 of the Punjab Factories VIRENDRA SINGH ADHIKARI 2022.09.06 17:51 I attest to the accuracy and authenticity of this order/judgment

Learned Senior counsel for the petitioner submits that the respondents themselves have reviewed their earlier stand and have passed the order granting exemption to the petitioner from compliance of Section 45(4) of the Factories Act, 1948 and from the requirement of the Rule 70 of the Punjab Factories Rules, 1952. Hence, the present petition has been rendered infructuous.
