The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of order dated 13.04.2026 (Annexure P-10) whereby respondent has rejected its application dated 30.10.2025 for extension of load. It is further seeking setting aside of final assessment orders for unauthorized use of electricity. It is also seeking direction to respondent not to disconnect electricity connection.

The petitioner is a partnership firm operating under the name and style of M/s Aadil Poultry. The respondent-PSPCL vide notice dated 01.12.2022 alleged theft of electricity and directed it to deposit Rs.10 lakhs as penalty. The respondent-PSPCL served further notices alleging pending liabilities. The petitioner filed civil suit before Ld. CWP-14795-2026 -2which vide interim order dated 01.03.2024 restrained the respondentPSPCL from disconnecting the electricity connection subject to depositing 1/3rd of bill dated 13.01.2024. The respondent-PSPCL in violation of the said order disconnected its electricity connection. The respondent-PSPCL vide order dated 01.08.2025 issued final assessment order followed by a spate of final assessment orders in the year 2025-26 alleging unauthorized use of electricity. The petitioner filed application dated 30.10.2025 with the respondent seeking extension of load which was rejected vide order dated 13.04.2026 on the ground that it could not prove its ownership.

Mr. Harshjit Singh, Advocate has filed Power of Attorney on behalf of respondent-PSPCL. The same is taken on record. Registry is directed to tag the same at an appropriate place. 4.

On being pointed out that petitioner has alternative remedy to file appeal under Section 127 of Electricity Act, 2003 (for short '2003 Act') with respect to assessment order and remedy to approach Redressal Forums as well as Ombudsman under Section 42(5) of 2003 Act with respect to other issues, the petitioner seeks permission to withdraw the petition with liberty to avail remedies as permissible by law. 5.

Dismissed as withdrawn with aforesaid liberty. 6.
