CRM-M-36466-2021 The instant Petition has been filed under Section 439 of the Code of Criminal Procedure seeking Regular Bail on behalf of the Petitioner in case FIR No.214, dated 09.03.2020, registered under Sections 307, 506, 120-B of the Indian Penal Code and Section 25 of the Arms Act, at Police Station Model Town, Rewari, Haryana.

The Petitioner has remained in detention for more than 1 year since 20.09.2020.

The Petitioner was not named in the FIR. His complicity has transpired from the Disclosure Statement of co-accused namely Harkesh. The Petitioner was himself not an actual assailant. DEEPAK KUMAR 2021.10.04 17:43 I attest to the accuracy and integrity of this document

Trial in the case is yet to commence even the Charges have not been framed.

Further detention of the Petitioner for an indefinite period, at this stage, in the given circumstances, is therefore not called for. As such, he is ordered to be released on bail subject to appropriate terms and conditions to the satisfaction of the Ld. Trial Court/Duty Magistrate concerned.
