**** SANJAY VASHISTH , J. (Oral) Learned State counsel has filed the status report dated 12.10.2022, by way of affidavit of Harsimran Singh Bal, PPS, Deputy Superintendent of Police (City-II), District SAS Nagar, on behalf of the respondent-State, in Court today, which is taken on record, subject to all just exceptions. Office to tag the same at appropriate place. A copy thereof has been handed over to the counsel for the petitioner.
Learned counsel for the petitioner refers to the order dated 31.08.2016, passed in CRM-M-26319-2016 (Sadhu Singh Randhawa Vs. State of Punjab) (Annexure P-2), whereby, petitioner was granted regular bail by this Court, by mentioning two conditions therein i.e.:- 1) Petitioner will not tamper with the evidence or hamper the further proceedings by, directly or indirectly, inducing or threatening the witnesses.
2) Petitioner will not leave India during the pendency of the trial and will deposit his passport with the trial Court. JAWALA RAM 2022.10.14 18:35 I attest to the accuracy and authenticity of this order/judgment.
CRM-M-33646-2022 (O&M) - 2 - Undoubtedly, the condition of not leaving the Country during the pendency of trial is mentioned in the order dated 31.08.2016 (Annexure P-2), but it does not mean that petitioner would not have any right for seeking permission in accordance with law to go abroad by showing his bona fides.
After arguing for some time, learned counsel for the petitioner seeks withdrawal of the present petition with liberty to approach the trial Court at the first instance for seeking permission as sought in the present petition, to visit Canada to meet his daughter. In view of above, present petition is allowed to be dismissed as withdrawn, and petitioner would be at liberty to move an appropriate application for seeking permission to go abroad and for release of his passport at the first instance before the trial Court and the same would be decided as per law. However, trial Court would make all possible endeavours to decide the application within a period of two weeks from the date of its filing.
