(Oral) The present appeal is directed against the judgment and decree dated 17.11.2007 passed by ADJ (Adhoc)/Fast Track Court Ambala whereby the appellant was granted decree of divorce with the condition that he will pay Rs.2,30,000/- along with interest @ 18 percent w.e.f March, 1999.
At the very outset, learned counsel for the appellant on instructions from the appellant (who is present in the Court) states that the appellant is ready to pay Rs.5,00,000/- towards full and final settlement. Learned counsel for the respondent has no objection to the above offer.
In view of the above, the appellant is directed to pay through RTGS of Rs.5,00,000/- in the account of the son of the parties namely Anmol (date of birth-02.12.1993), who has attained majority. FAO-M-63-2008 shall be paid within a period of one month.
Learned counsel for the respondent is directed to share account no of the son of the parties so that the appellant can transfer the above amount in the account of his son through RTGS within a period of one month.
Statement of the appellant is also recorded to this effect and the same is taken on record as Annexure A-1.
In view of the fact that the matter stands compromised between the parties, the present appeal is disposed of and judgment and decree dated 17.11.2007 passed by ADJ (Adhoc)/Fast Track Court Ambala is modified to the extent that the appellant will pay lump sum of Rs.5 lacs as full and final payment in the account of his son instead of Rs.2,30,000/- along with 18 percent interest w.e.f March, 1999, which was granted to the respondentwife.
