The petitioner has approached this Court under Articles 226/227 of the Constitution of India, for issuance of a writ in the nature of Certiorari for quashing/setting aside order dated 15.05.2017 (Annexure P-2) whereby the petitioner was transferred at the verge of his retirement by ignoring the status of couple case and overlooking the transfer policy dated 06.10.2004 (Annexure P-1).
The main grouse of the petitioner is that this is the last year of his superannuation and according to transfer policy Annexure P-1 an employee whose service is left for one year should not be transferred. Learned counsel for the petitioner contends that the instant petition may be disposed of by directing the competent authority to decide the detailed and comprehensive representation annexing all the relevant documents so to be filed by the petitioner within a reasonable period.
