The petitioners through instant petition under Article 226/227 of the Constitution of India are seeking setting aside of order dated 25.11.2025 whereby respondents have granted Rs.10,59,978/- on account of death of his son. He is further seeking reasonable compensation as per policy dated 08.07.2019.

This is second round of litigation. The petitioner on an earlier occasion approached this Court by way of CWP-30778-2025 which was disposed of vide order dated 16.10.2025 to decide his claim. The respondent vide order dated 25.11.2025 granted him compensation of Rs.10,59,978/- in view of death of his son. He claims that the compensation has not been calculated as per the policy as well as not taking into account the profession of the deceased. The respondent has wrongly assessed monthly income to the tune of Rs.10,098/-. DEEPAK BISSYAN 2026.05.13 16:59 I attest to the accuracy and authenticity of this order/judgment

Learned counsel for the petitioner submits that respondent has wrongly assessed monthly income of Rs.10,098/- whereas as per notification dated 03.01.2020 issued by Ministry of Labour & Employment, it should be Rs.15,000/-. The aforesaid notification is squarely applicable to the petitioner.

Learned counsel for the respondent expressed her inability to controvert the applicability of notification dated 03.01.2020 to the present case.

In the backdrop, the petition stands disposed of with a direction to respondent to reassess quantum of compensation considering aforesaid notification dated 03.01.2020. Let the needful be done within six weeks from today.
