The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to grant promotion in terms of order dated 18.03.2010 passed by Division Bench of this Court in CWP No.12741 of 2009.

The petitioner is working with respondent-Cantonment Board, Jalandhar. He is 95% disabled in terms of provisions of the Persons with Disability (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.

Mr. Rajiv Joshi, Advocate, submits that despite disability, the petitioner has not been promoted.

Mr. Dheeraj Chawla, Advocate, submits that there is one post meant for persons with disability. There are three persons in the office of respondent-Board who are disabled. One person is occupying the promotional post and another person is senior to petitioner. As soon as senior of the petitioner would retire and post gets vacant, the petitioner would be considered for promotion and if found eligible, would be promoted.
