The petitioner seeks regular bail in FIR No. 271 dated 1.7.2021 under Sections 147, 149, 294, 323, 440, 506 IPC, registered at Police Station Tosham, District Bhiwani.

Learned counsel for the petitioner submits that though the petitioner has filed the application before the Session Court, Bhiwani under Section 439 Cr.P.C., yet inadvertently, the learned Additional Sessions Judge, Bhiwani, considered the said application under Section 438 Cr.P.C, while dismissing the same on 11.8.2021.

Learned counsel for the petitioner submits that he may be permitted to withdraw the petition with liberty to file a fresh application under Section 439 Cr.P.C., before the learned Sessions Court.
