The learned State counsel has filed the status report by way of an affidavit of the Deputy Superintendent of Police (Headquarter)-cumDeputy Superintendent of Police, Sub Division Shahkot, District Jalandhar. The same is taken on the record. A copy thereof has been supplied to the learned counsel representing the petitioner.

The petitioner prays for grant of regular bail during the pendency of the criminal case arising from the FIR No. 138 dated 07.08.2021, registered under Section 363 and 366 IPC (Section 376 IPC and Section 5 and 6 of the Protection of Children from Sexual Offences Act, 2012 were added lateron), at Police Station Shahkot, District Jalandhar. 3.

2023:PHHC:082599 Criminal Misc. No. M-31211 of 2023 Aishnoor when she was minor. It has come on record that subsequently, the petitioner married Aishnoor on 10.01.2022 and the couple was blessed with a daughter on 18.01.2023. The petitioner wishes to stay with his wife and daughter. The learned counsel representing the first informant (father of Aishnoor) has no objection if the petitioner is granted the concession of bail .

Keeping in view the aforesaid facts and without commenting on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of the learned Chief Judicial Magistrate/Area Judicial Magistrate/Duty Magistrate concerned.
