Learned counsel for the petitioner very fairly states that keeping in view the order passed by this Court in CWP-25942-2012 titled as 'Suresh Sharma Vs. State of Punjab and others', decided on 11.04.2019, which order has already been upheld by the Division Bench of this Court in LPA No.892 of 2019 titled as 'Surinder Krishan Sharma Vs. CWP-10096-2018 -2petitioner be relegated to avail his remedy before the Educational Tribunal, Punjab.

Counsel for the petitioner states that as the pleadings in this writ petition are complete and in case the petitioner is forced to file fresh pleadings before the Educational Tribunal, Punjab, not only the same will consume time, but the same pleadings will have to be filed again which will waste the time of Tribunal as well. Therefore, the record of the present writ petition be sent to the Educational Tribunal, Punjab, for passing an appropriate order on the grievance raised by the petitioner. Counsel appearing on behalf of the respondents states that they have no objection in case the record of the present writ petition is sent to the Educational Tribunal, Punjab for passing the appropriate orders.

In view of the above, the petitioner is relegated to avail his remedy before the Educational Tribunal, Punjab. Let the record of this writ petition be also sent to the Educational Tribunal, Punjab, for passing appropriate orders. Parties are directed to appear before the Educational Tribunal, Punjab, on 15.10.2019.
