***** Rajan Gupta, J. (Oral) Petitioner is aggrieved by order dated 03.11.2014 passed by respondent No.4 whereby contract of the petitioner for providing mid-day meal to school children has been terminated. According to learned counsel, no opportunity of hearing was granted to the petitioner before passing the impugned order. Besides, the policy envisages that the mid-day meal has to be supplied by the Self Help Groups. The task cannot be undertaken by the school authorities itself. He relies upon judgment delivered by this court in CWP-20653-2010 decided on 22.09.2014.

Faced with this situation, learned State counsel submits that the entire matter shall be looked into by respondent No.2-Additional Deputy Commissioner (D), Bathinda, and a fresh order shall be passed keeping in view the facts and circumstances and the prevalent policy. In view of the above, no further direction is necessary. The petition is hereby disposed of.

It is made clear that order dated 03.11.2014 would not stand in the way of concerned authority while considering the matter afresh.
