*** Present: Mr.J.P.Sharma, Advocate, for the petitioner. -.- Surya Kant, J . (Oral) The petitioner bought Plot No.1173 (135 square meters) situated on Sector-1, Part-1, HUDA, Narnaul, from its second allottee by way of a registered sale deed dated 14.09.2011. She thus stepped into the shoes of the original allottee/second allottee. Her grievance in the instant writ petition is that the above-stated plot became subject-matter of litigation in the Civil Suit No.445 which has since been decreed against HUDA. Resultantly, the petitioner has not been offered physical possession of the plot at the site. She seeks a direction for allotment of an alternative plot in terms of HUDA policy as well as on the ground of parity as several other similarly affected allottees have been given alternative plots for one or the other valid reason.

Such a claim, which prima-facie appears to be fair and just, has been raised by the petitioner vide representation dated 11.01.2016 (P-5) but finding no response thereto, she has filed the instant writ petition. Having heard learned counsel for the petitioner and considering the nature of relief sought by her, we dispose of this writ petition with a direction to respondent Nos.2 & 3 to verify the facts and if the abovementioned averments are found to be correct, let necessary steps for Mohinder Kumar Kamboj 2017.01.18 15:46 I attest to the accuracy and integrity of this document Chandigarh
