The prayer in the present petition under Section 528 BNSS/Section 482 Cr.P.C. is for the issuance of directions to the respondents to transfer the petitioner who is presently confined in District Jail, Karnal in FIR No. 82 dated 26.04.2024 under Sections 7 and 8 of the PC Act, Section 42-A of the Prison Act and Sections 120-B and 201 IPC (added later on) corresponding to Sections 61 and 238 of the BNS registered at Police Station Thanesar City, District Kurukshetra to any other Jail except District Jail, Karnal as there is insufficient medical care available.

The learned counsel for the petitioner contends that the petitioner is unable to obtain adequate medical care at District Jail, Karnal and therefore, he be transferred to any other district. 3.

The learned counsel for the State, on the other hand, contends that the petitioner is being given adequate treatment in District SUKHPREET KAUR 2026.05.28 12:34 I attest to the accuracy and integrity of this document chandigarh

CRM-M-29769-2026 (O& M) Jail, Karnal. In fact the petitioner seeks transfer so as to be able to run his gang related activities from the Jail and is facing difficulty at District Jail, Karnal for the said purposes. As many as 16 other cases are pending against the petitioner. Therefore, the present petition has been filed with an oblique motive. 4.

I have heard the learned counsels for the parties. 5.

Apparently, the petitioner is a serial offender with 16 other cases registered against him. The hospitals at Karnal can provide adequate treatment to the petitioner, if required.

In view of the above, the present petition stands dismissed. 7.
