P.B. Bajanthri, J. (Oral) In the instant writ petition, the petitioner has sought for a direction to the respondents to take him to duty with all consequential benefits or in the alternative to decide his representation dated 8.1.2016 (Annexure P-3).
2) The petitioner was stated to be appointed as a Sweeper on 12.3.1987. It seems petitioner's services were terminated on 10.6.1988, which was subject matter of the litigation. This Court in CWP No. 8262 of 1990, directed the respondents to decide his representation within a period of 6 months. On 14.3.1995, the Food Corporation of India passed an order that the petitioner is not entitled for any service benefits including regularization. Thereafter petitioner kept quite upto the year 2010. In the year 2010 he raised an industrial dispute. The Industrial Tribunal rejected his claim. 3) Having regard to the conduct of the petitioner, as well as, delay and latches in the matter, this Court proceeded to dismiss the present writ petition. At this juncture, learned counsel for the petitioner sought for withdrawing the petition. The petitioner is permitted to withdraw the petition.
