On our asking, Ms.Kirti Singh, learned Deputy Advocate General, Haryana, accepts notice on their behalf. Let three copies of the writ petition be supplied to the State counsel during the course of day failing which this order shall be automatically recalled and the writ petition shall be deemed to have been dismissed for non-prosecution. In view of the nature of order which we propose to pass, it is not necessary to seek any counter-reply from respondent Nos.1 to 3 or to serve respondent Nos.4 & 5 at this stage as no order prejudicial to their interest is being passed. The short grievance of the petitioner is that his house No.250 is located in Ward No.1 of Municipal Committee MOHINDER KUMAR 2015.08.13 16:31 I attest to the accuracy and authenticity of this document Chandigarh
CWP No.16430 of 2015 [2] Colony, Charki Dadri, District Bhiwani but while undertaking the exercise of delimitation for the purpose of carving out new wards, the petitioner's house is being shifted to a new ward. The petitioner is said to have submitted a representation (P-4) in this regard to the Executive Officer/Secretary of Municipal Committee, Charki Dadri.
Having heard learned counsel for the petitioner and the State, however, without expressing any views on merits, we dispose of this writ petition with a direction to the Deputy Commissioner, Bhiwani, to call for the records of Secretary/Executive officer of the Municipal Committee, Charki Dadri and take a decision or relegate the matter to the Competent Authority, whosoever may be, to decide the petitioner's representation, referred to above in accordance with law.
Let the needful be done before the elections of Municipal Committee are held.
Ordered accordingly.
